1. Definitions

Customer means any individual, business, landlord, agent, or organisation who requests or receives services from Waste Clearance Kentish Town.

2. Scope of Services

We provide waste collection and clearance services for domestic and commercial customers within our service area, which includes Kentish Town and surrounding districts. Our services may include collection, loading, transport, and disposal or recycling of non-hazardous waste.

We reserve the right to refuse to collect any items that we reasonably believe to be hazardous, illegal, unsafe to handle, or outside the agreed scope of work. This includes, without limitation, asbestos, clinical or medical waste, chemicals, solvents, paint tins containing liquid, gas bottles, oil, fuel, explosives, and any other material that may present a health and safety risk or require specialist disposal.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any booking facility we make available. The Customer is responsible for providing accurate information about the type and quantity of waste, the collection address, access conditions, and any relevant time restrictions.

3.2 We may provide an estimated price based on the description of the waste or on any images submitted by the Customer. This estimate is not binding and is subject to confirmation upon our arrival and inspection of the waste on site.

3.3 A booking is only considered confirmed when we have accepted the order and provided a booking confirmation, which may be verbal, by email, or by message. We reserve the right to decline any booking request at our discretion.

3.4 The Customer must ensure that a responsible person is present at the collection address at the scheduled time to grant access, confirm the items to be removed, and authorise any additional charges if applicable.

4. Access and Site Conditions

4.1 The Customer must provide safe, reasonable, and unobstructed access to the waste to be removed. This includes adequate parking or stopping space for our vehicles as close as reasonably practicable to the collection point.

4.2 If permits, parking suspensions or third-party consents are required for us to park or access the property, it is the Customer's responsibility to obtain them in advance unless otherwise agreed in writing. Any penalties, fines or additional costs incurred due to the absence of such permissions may be charged to the Customer.

4.3 If we are not able to carry out the Services due to unsafe conditions, blocked access, incorrect address details, or the Customer's failure to be present, we may cancel or re-schedule the booking and may charge a call-out or wasted journey fee.

5. Pricing and Quotations

5.1 Prices are generally based on the volume and type of waste collected, the weight where applicable, labour time, and any additional factors such as difficult access, excessive loading time, or special handling requirements.

5.2 Any quotation provided before arrival is an estimate only and may be adjusted once we have inspected the waste on site. If the actual load or work required differs from the Customer's description, we will provide an updated price before commencing the work.

5.3 All prices are quoted in pounds sterling and may be subject to VAT where applicable. Any applicable charges will be explained at the time of booking or before the work begins.

6. Payments

6.1 Payment is due in full upon completion of the Services, unless an alternative arrangement has been agreed in advance for account customers or regular commercial clients.

6.2 We may accept payment by cash, debit or credit card, bank transfer, or other methods as notified to the Customer. We reserve the right to require payment in advance or a deposit at the time of booking for certain jobs or for new commercial accounts.

6.3 Where payment is not made on completion, we may issue an invoice payable within a specified number of days. If the Customer fails to make payment by the due date, we reserve the right to charge interest on the overdue amount and to recover any reasonable costs of collection, including legal and administrative expenses.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving us as much notice as reasonably possible. Cancellations should be made by telephone or email using the contact details provided at the time of booking.

7.2 We reserve the right to apply a cancellation charge if the Customer cancels with short notice, typically less than 24 hours before the scheduled arrival time, or if our team has already been dispatched to the site.

7.3 If we cannot carry out the Services due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, traffic disruption, or illness, we may reschedule the booking without liability for any indirect or consequential loss. In such cases, we will offer the next available appointment and will not charge a cancellation fee.

8. Customer Obligations

8.1 The Customer warrants that they either own the waste being removed or have the authority of the owner to arrange its collection and disposal.

8.2 The Customer must clearly identify and present the waste to be removed. We will not be liable for removing any items that are presented to us and reasonably appear to be waste, even if they are subsequently found to have been removed in error.

8.3 The Customer must inform us in advance of any items requiring special handling, any potentially hazardous materials, or any conditions at the property that could affect health and safety, such as sharp objects, contamination, or structural hazards.

9. Waste Handling and Regulations

9.1 We operate in accordance with applicable waste management laws and regulations in the United Kingdom. We will transport and dispose of waste using authorised facilities and will take reasonable steps to maximise reuse and recycling wherever feasible.

9.2 We are not obliged to accept any waste that would put us in breach of law or regulation. We may refuse to remove any items that we reasonably suspect to be hazardous or unsuitable for transport or disposal through our normal channels.

9.3 Upon removal of the waste, responsibility for its lawful disposal transfers to us. The Customer acknowledges that we may segregate, sort, or process waste for the purposes of recycling, recovery, or disposal at licensed sites.

9.4 The Customer must not use our Services to dispose of any illegal items or substances. If we become aware that waste contains such items, we may notify the relevant authorities and reserve the right to recover from the Customer any costs, liabilities or penalties incurred as a result.

10. Liability and Limitations

10.1 We will exercise reasonable skill and care when providing the Services. However, the Customer accepts that minor scuffs or marks may occur to walls, floors, or door frames during the removal of large or heavy items, and that such minor cosmetic damage will not be treated as negligence where all reasonable care has been taken.

10.2 Our liability for any loss or damage arising out of or in connection with the provision of the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the relevant Services, except where such limitation is not permitted by law.

10.3 We will not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, or loss of opportunity, whether foreseeable or not, resulting from any delay, cancellation, or failure to provide the Services.

10.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded.

11. Customer Property and Items Not Taken

11.1 The Customer is responsible for checking that only waste is presented for removal. We accept no liability for the removal of items that the Customer or property occupants later claim were not intended to be disposed of, provided that such items could reasonably be construed as waste at the time of collection.

11.2 If we agree to move or handle items that are not being disposed of, this is done entirely at the Customer's risk. We will take reasonable care, but shall not be liable for damage to such items unless caused by our negligence.

12. Delays and Waiting Time

12.1 We will make reasonable efforts to attend at the agreed time, but any time given is an estimate only and not guaranteed. The Customer acknowledges that delays may occur due to traffic, previous jobs, access issues or other factors beyond our direct control.

12.2 If our operatives are required to wait beyond a reasonable period on arrival due to the Customer not being ready or available, we reserve the right to charge a waiting time fee in accordance with our current rate structure.

13. Data Protection and Privacy

13.1 We may collect and process personal data such as names, contact details, addresses and payment information for the purposes of managing bookings, delivering Services, handling enquiries, and complying with legal obligations.

13.2 We will take reasonable measures to safeguard personal information and will not sell or disclose it to third parties except as required to deliver the Services, process payments, recover debts, or comply with legal or regulatory requirements.

14. Complaints

14.1 If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as reasonably possible, providing full details of the issue and any supporting information.

14.2 We will investigate complaints in a fair and timely manner and, where appropriate, offer a remedy which may include re-attendance, partial refund, or other resolution at our discretion.

15. Changes to these Terms

15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that particular provision of Services.

15.2 Any significant changes will be made available through our usual communication channels. Continued use of our Services following any changes constitutes acceptance of the updated Terms and Conditions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of our Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the Services, and supersede any prior understandings, representations or agreements, whether written or oral.
